WorldWideWeb Terms of Use
DRAFT. Not yet reviewed by a lawyer. Fill in every [BRACKETED] item before publishing.
Effective date: [DATE]
These Terms of Use (“Terms”) are an agreement between you and [OPERATOR NAME] (“we”, “us”, “WorldWideWeb”), the operator of the website at https://worldwideweb-59z.pages.dev and any other address we use for it (the “Site”).
By using the Site, or by creating an account, you agree to these Terms. If you do not agree, do not use the Site.
1. Who can use the Site
1.1 You must be at least [13 — or 16 if you accept users in the European Union] years old to create an account.
1.2 You must give a working email address when you sign up. You are responsible for keeping your password secret and for everything done through your account.
1.3 You may not create accounts by automated means, or use another person’s account without their permission.
2. Your contributions are voluntary
2.1 Anything you post on the Site is a “Contribution”. Contributions include entries, edits, edit notes, category names and descriptions, and your username.
2.2 You make every Contribution voluntarily. You are not required to contribute, and you will not be paid or otherwise compensated for any Contribution. This applies even if we or others later earn money from the Site or from your Contributions.
2.3 Contributions are public. Do not post anything you want to keep private or confidential.
3. Contributions become the property of WorldWideWeb
3.1 Transfer of ownership. When you submit a Contribution, you transfer and assign to us all right, title and interest in it, worldwide. This includes all copyright and other intellectual property rights. The transfer takes effect the moment you submit the Contribution. From then on, the Contribution is our property.
3.2 Backup license. In some places the law may not allow, or may limit, the transfer in section 3.1. To the extent that happens, you instead grant us an exclusive, perpetual, irrevocable, worldwide, royalty-free, transferable licence to use your Contribution in any way. That includes the right to sublicense it. “Use” includes copying, editing, adapting, translating, combining with other material, publishing, distributing, displaying, selling, and making other works from it, in any media or format now known or developed later.
3.3 Moral rights. To the extent the law allows, you waive any “moral rights” in your Contributions. Where they cannot be waived, you agree not to enforce them against us or against people we authorise. Moral rights include the right to be named as author and the right to object to changes.
3.4 Edits by others. Other users may edit your Contributions, and we may edit or remove them. Edited versions are also our property under this section.
3.5 After you leave. Contributions stay on the Site, and remain our property, after you stop using the Site or close your account.
3.6 Your promise about what you post. For every Contribution, you confirm that: - it is your own original work, or you have every permission needed to give us the rights in this section; and - posting it does not break any law or infringe anyone else’s rights.
4. Content rules
You must not post anything that: - infringes someone else’s copyright, trademark or other rights, including text copied from other websites or books without permission; - is false and harms someone’s reputation (defamation); - harasses, threatens, or promotes violence or hatred against any person or group; - sexualises minors in any way, or is otherwise sexually explicit; - reveals another person’s private information, such as their home address, phone number or identity documents; - is spam or advertising, or contains malicious code or misleading links; - impersonates another person or organisation; or - is otherwise illegal where you live or in [COUNTRY/STATE].
5. You are responsible for your posts
5.1 You alone are responsible for your Contributions and for any consequences of posting them.
5.2 Contributions are written by users, not by us. We do not check them before they appear. We do not confirm that they are accurate, complete or up to date, and we do not endorse them. A Contribution’s appearance on the Site does not mean we agree with it.
5.3 Do not rely on the Site for medical, legal, financial or safety decisions. Check important information with a qualified professional or another reliable source.
6. Moderation
6.1 We may review, edit, hide or remove any Contribution, category or account, at any time, for any reason or no reason, with or without notice.
6.2 We are not obliged to monitor the Site. If we choose not to act on some content, that does not mean we approve of it.
7. Reporting content
7.1 To report content that is illegal, infringes your rights, or breaks these Terms, email [CONTACT EMAIL]. Include: - the address (URL) of the page; - what is wrong with it, and for copyright, which work you own that is being infringed; - your name and contact details; and - a statement that your report is accurate and made in good faith.
7.2 We will review reports within a reasonable time and remove content where appropriate.
8. You will cover our costs if your posts cause a claim
You agree to defend, indemnify and hold harmless [OPERATOR NAME] against any claims, losses, damages, fines, costs and expenses, including reasonable legal fees, that arise from: - your Contributions; - your use of the Site; or - your breach of these Terms or of any law.
9. No warranties
The Site is free. It is provided “as is” and “as available”, without warranties of any kind, express or implied. That includes warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not promise that the Site will be available, secure or error-free, or that any content will be kept.
10. Limitation of liability
10.1 To the maximum extent permitted by law, [OPERATOR NAME] and anyone acting on its behalf are not liable for any loss or damage arising from: - any Contribution or other content posted by users; - your use of, or inability to use, the Site; - any information on the Site, or decisions you make based on it; - unauthorised access to your account or data; or - any interruption, error, or loss of content.
This applies whether the claim is based on contract, negligence or any other legal theory, and even if we were told such loss was possible.
10.2 To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill.
10.3 If we are found liable despite the above, our total liability to you for all claims is limited to [USD 50].
10.4 Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law.
11. Ending your use
11.1 You may stop using the Site at any time. You can ask us to close your account by emailing [CONTACT EMAIL]. Section 3.5 explains what happens to your Contributions.
11.2 We may suspend or end your access at any time, including if you break these Terms.
11.3 Sections 2, 3, 5, 8, 9, 10 and 13 continue to apply after your access ends.
12. Privacy
Our Privacy Policy, at [LINK], explains what information we collect and how we use it. Among other things, it covers searches on the Site, which are recorded to produce the Trend Rank.
13. General
13.1 Changes. We may update these Terms. We will post the new version on the Site with a new effective date. If you continue to use the Site after that, you accept the new Terms.
13.2 Governing law. These Terms are governed by the laws of [COUNTRY/STATE]. Disputes go to the courts of [CITY, COUNTRY/STATE], unless the law of your country gives you the right to bring a claim where you live.
13.3 Whole agreement. These Terms and the Privacy Policy are the whole agreement between you and us about the Site.
13.4 Severability. If any part of these Terms is found unenforceable, that part is limited or removed only as far as necessary, and the rest stays in effect.
13.5 Transfer. We may transfer these Terms, and our rights in Contributions, to anyone else. You may not transfer your rights under these Terms.
13.6 No waiver. If we do not enforce a part of these Terms, we have not given up our right to enforce it later.
